1. Nature of the Work Hearkken Adaptive 3D Stage Development specializes exclusively in the recreation of environments. These recreations are not intended to be exact replicas or direct copies of any specific artistic concept. Each element is built from the ground up (built from scratch), ensuring original production without the intent of copying for unauthorized distribution. Our brand also serves as a formal attribution and credit system for all developed stages.

2. Intellectual Property and Usage Restrictions The resale of any Hearkken product to third parties is strictly prohibited. Furthermore, the unauthorized distribution of our files is severely forbidden. Each stage includes a digital brand signature, allowing us to identify and track every active project and protect our intellectual property.

3. Collaborations and Lighting Policy Hearkken collaborates with various virtual brands; however, we are not responsible for the programming or distribution of third-party or unregistered lighting systems.

The only lighting systems sold or included will be those developed in-house or through official partnerships with brands that explicitly authorize their distribution.

We are strictly prohibited from implementing lighting assets that are not our own.

2. Copyright Compliance and Originality To ensure full compliance with international copyright laws, all stages are reinterpretations of real-life concepts and not exact replicas.

• Projects will not contain logos, trademarks, or symbols belonging to third-party corporations.
• Each asset is built from scratch, serving as a creative tribute or interpretation rather than an infringing copy.
• Dimensions are approximate to real-life scales but are not exact, further distinguishing our work as an original artistic model.

3. Project Specifications Each recreation will be delivered with technical details specified according to its category (Standard Store Asset or Custom Commission).

4. Custom Commissions and Ownership Regarding personalized commissions based on specific stage concepts:

Once a commission is completed, Hearkken retains full authorship, allowing the project to be added to our official catalog for future sales

Hearkken reserves the right to distribute these projects in the Hearkken Store at our discretion and at a price determined by us.

Terms and Conditions for Original Creations

1. Hearkken Originals (Registered Intellectual Property) All projects categorized as “Hearkken Originals” are 100% original designs created by our team. These are not recreations of existing real-world or virtual stages.

• Distribution Rights: These projects have limited distribution rights.
• Resale Prohibition: The sale of these assets to third parties is strictly prohibited, as each project is officially registered under Hearkken’s ownership.

2. Hearkken Commission Originals (Custom-Made Concepts) This category covers projects built to the specific requirements and measurements of a client.

• Usage Rights: The client is granted full access and freedom to use the stage as they see fit, as it is a bespoke concept tailored to their needs.
• Composition and Pricing: These concepts may incorporate elements from other stages (either real-life references or existing Hearkken assets). The final cost will be calculated based on the stipulated project price plus current applicable taxes.

3. Project Identification The “Hearkken Originals” label is used exclusively to identify projects that are 100% original intellectual property, ensuring they are not artistic copies or recreations of any other existing environment.

2026 Commission Policy and Pricing

. Pricing Structure Starting in 2026, all Hearkken commissions—whether for recreations or original creations—are subject to a hybrid pricing model:

• Base Rate: A minimum fixed fee of $185 USD.
• Hourly Rate: $6.83 USD per hour.
• Calculation: If the total labor hours multiplied by the hourly rate is less than or equal to the base rate, the client pays the $185 USD minimum. If the labor hours exceed this minimum, the final price will be calculated based on the total hours worked (Base + Extra Hours).

2. Quotes and Project Estimates Clients may submit a concept for review. Upon inquiry, Hearkken will provide a preliminary hour estimate to give the client an expected valuation of the project. File formats are flexible and will be determined based on the developer’s tools and the specific needs of the client.

3. High-Detail Real-Dimension Projects Commissions requiring exact real-life dimensions are treated as high-precision, delicate projects.

• These projects automatically apply the hourly rate on top of the base fee due to the increased level of detail and complexity.

4. Timeline and Live Project Tracking

Live Status Tracking: All commissioned projects (including those for active events) will be updated on our website’s Status Page, where clients can monitor the real-time progress of their stage.

Estimated Duration: Each project has an average duration depending on the developer’s workflow. Please note that the initial status estimate may vary and is not a binding guarantee of the final delivery date.

Hearkken Subscription Center

1. Subscription Plans and Fixed Pricing Hearkken offers four distinct subscription tiers with fixed pricing and specific benefits. Please note that benefits are strictly limited to those outlined in each plan; any service or asset outside of these predefined benefits cannot be claimed by the customer.

Prices are subject to fixed rates throughout the 2026 calendar year:

• BASIC VIP: $4.99 USD
• VIP: $9.99 USD
• PREMIUM: $24.99 USD
• DIAMOND: $59.99 USD

2. Activation and Communication Subscriptions are automatically activated on the date of purchase. Upon activation, customers will receive official notifications regarding their status, current benefits, and upcoming updates. To ensure full access to these benefits, customers must provide accurate contact information and usernames, and maintain consistent communication with our team.

3. Store Discounts and Coupons Subscribers are entitled to a discount on specific assets within the Hearkken Store for the duration of their membership.

• This discount is applied via a unique coupon code.
• Exclusions: Discounts are applicable to specific store stages except for custom commissions.

4. Membership Renewal and Commissions Subscription status is valid for 30 days. At the end of this period, the membership and its associated benefits will either be renewed or revoked based on the user’s billing status.

Hearkken Store Center

1. General Overview The Hearkken Store is our official platform for the sale and distribution of original environments (Hearkken Originals) and our professional recreations. Pricing is determined at our sole discretion. Each project is delivered in a fixed set of formats; please note that we do not offer alternative formats beyond those provided at the time of purchase.

Standard Deliverables:

• .BLEND / .3MF /.GLTF / .OBJ / .MTL / .FBX Note: Read Desc of each model you want to buy, not every model has the same format files.
• Full Texture Folder

2. Delivery Process Upon purchase, the customer will receive a PDF document containing:

• A direct download link (Google Drive).
• An encryption password for the .ZIP file.
• Official contact numbers for support.
• Promotional images and the 3D stage in all aforementioned formats.

3. Download Limits and Expiration

• Access Limit: The PDF document can be downloaded a maximum of two (2) times.
• Expiration: The download link remains active for a period of five (5) days. After this timeframe, the link will expire.

4. Compatibility and Technical Responsibility Before submitting a complaint, customers must verify the compatibility of their specific software with our provided formats.

• Hearkken assets are rigorously tested, visualized, and evaluated in Blender.
• Hearkken is not responsible for compatibility issues with third-party software or engines. It is the buyer’s responsibility to ensure their workflow supports the formats listed above.

5. Refund Policy and Taxes

No Refunds: All sales in the Hearkken Store are final. No refunds will be issued once the asset has been assigned to the customer.
